I think you've found the source of your problem.
Can you please try the solution suggested on the github page, to force the download of the XBox ISOs from within the game (Please make sure you download the.iso from the master branch, rather than the master tag)
of the fact-finder, to be taken as true if he makes such findings. The burden of proof as to every issue in the case shall be upon the party asserting it.
While the petitioner admits that the grounds upon which the trial court based his judgment denying relief were correct, he argues that the court erred in refusing him a hearing on a plea of estoppel which was set up in his amended application. We agree. In the absence of a motion to dismiss, supported by affidavit or otherwise, the petitioner should have been granted a hearing on the plea.
The judgment is reversed and the cause is remanded to the circuit court with directions to grant the petitioner a hearing on his amended application for relief.
We have also examined the two petitions for writs of error coram nobis filed in this Court by petitioner's appointed counsel. As pointed out in Jones v. State, 36 Ala.App. 174, 53 So.2d 702, "The proceedings taken in this Court are not made a part of the record on appeal; hence, it is our duty to act only on the record made in the trial court. In this posture, we are not permitted to go into the records of the proceedings in the trial court for the purpose of satisfying ourselves as to the sufficiency of the evidence to support the finding of the trial court; but must limit our inquiry to the record made in the trial court. Hamilton v. State, 210 Ala. 480, 98 So. 630; Smith v. State, 238 Ala. 329, 191 So. 390; Snellings v. State, 243 Ala. 527, 11 So.2d 554."
*251 We have reviewed the two petitions for writs of error coram nobis, and they do not raise any issues not disposed of on the record before the trial court. Hence, we need not consider them.
Reversed and remanded.
